1. Who processes your data
The data controller is UNIRENT SOFTWARE S.R.L., the company that operates inchirieri.ro:
- VAT ID RO37446534, Trade Register No. J23/964/2020;
- registered office: Drumul Gării Odăi 2-4-6, postal code 075100, Otopeni, Ilfov county, Romania;
- person responsible for the processing of personal data: Emil Voica;
- e-mail: [email protected] · phone: +40 750 111 000.
This page informs you about the processing of your personal data when you use the website. (Ch. I)
2. What data we collect
If you are a customer (you have placed a request or a booking), we process:
- your first and last name, phone number and e-mail address;
- your billing address and delivery address;
- your personal identification number, for invoicing, in some cases (to validate your age);
- data about how you use the website (behaviour, preferences, habits);
- any other data you give us directly when you place an order or use the website.
If you are a visitor, we process only the data you give us directly, for example through the contact, questions or complaints section. We may contact you by any means you have made available on the website, in order to complete the contract. (Ch. II)
3. Why we use it and on what legal basis
To carry out the booking. We take, validate and invoice the booking placed on the website, organise the delivery and keep you informed about the status of the order. The legal basis is the request you placed on the website (the contract). Providing the data is necessary: without it we cannot carry out the booking.
For our legal obligations, including tax and archiving obligations. The legal basis is the legal obligation, and providing the data is necessary.
For commercial communications (marketing). We send you offers only with your consent. Providing data for this purpose is voluntary, and refusing has no negative consequence for you.
For analysis and improving the website. We produce analyses and reports on how the website works and consumer preference profiles, in order to improve the experience we offer. The legal basis is our legitimate interest; providing the data is voluntary.
To handle visitors' rental requests. As a broker, we handle your request and place it in the providers' system; we also answer questions, comments and complaints. The legal basis is our legitimate interest in making sure the website works properly; providing the data is voluntary. (Ch. III)
4. How long we keep the data
- As a rule, we keep the data for as long as needed for the purposes above, but no longer than 5 years from the delivery date of the car (mainly for traffic fines and other incidents).
- If you are a customer, we keep it for the whole duration of the contractual relationship and afterwards for as long as the law requires. For example, financial and accounting documents are kept for 10 years from the end of the financial year in which they were drawn up.
- Unsubscribing. If you ask us to delete your account or your data, by e-mail or by phone, we consider that you also unsubscribe from commercial communications: we no longer send you e-mails or text messages, not even if you book a car again.
- Active orders. If you have an order in progress, the deletion request can be registered only after the car has been delivered and the last active order has been completed.
- Withdrawing consent for marketing stops the processing for this purpose, without affecting the processing carried out before the withdrawal.
(Ch. IV)
5. Who we share the data with
We may share your data with partners and third parties who support us in carrying out our activity, as well as with public authorities, for example:
- the rental company that delivers your car: we pass on your name and phone number, for drawing up the rental agreement, delivering the car, notices and invoicing. We pass your e-mail address to the provider only for traffic fines or in specific situations that require it (for example data protection notices, such as a security breach); we nevertheless reserve the right to pass it on whenever we consider it necessary.
- web hosting companies and IT service providers, for running, maintaining and improving the website;
- for data analysis, testing, monitoring of usage and developing safety features;
- for sending commercial communications, under the conditions and within the limits of the law;
- for awarding prizes or benefits in promotional campaigns you take part in;
- authorities, when disclosure is required by law.
Authorisation. By placing a booking you authorise us to register your order with the provider you chose from those listed in Art. 32 of the Terms and conditions, or with any other car rental provider approved by us or under contract with us. (Ch. V)
6. Transfer of data outside Romania
Your data may be transferred outside Romania, but only to countries in the European Union. (Ch. VI)
7. Your rights
Under data protection legislation, you have the following rights:
- The right to be informed: to receive details about the processing we carry out.
- The right of access: to obtain confirmation that we process your data and details about how, for what purpose and to whom we pass it.
- The right to rectification: to have inaccurate data corrected and incomplete data completed. We also communicate the rectification to the recipients of the data, unless this is impossible or disproportionate.
- The right to erasure (“the right to be forgotten”): when the data is no longer needed, when you withdraw your consent and there is no other legal basis, when you object to the processing and there are no overriding legitimate grounds, when the data has been processed unlawfully or when the law requires erasure. Following the request, we may anonymise the data and continue to use it only for statistical purposes.
- The right to restriction of processing: while we verify the accuracy of contested data, when the processing is unlawful but you do not want erasure, when you need the data to defend a right in court, or while we assess your objection.
- The right to data portability: to receive the data in a structured, easily readable format and to ask for it to be transmitted to another controller, under the conditions of the law.
- The right to object: you may object at any time to processing based on our legitimate interest, for reasons related to your situation, and, free of charge and without any justification, to processing for direct marketing purposes.
- The right not to be subject to an automated individual decision, including profiling, which produces legal effects or significantly affects you.
- The right to lodge a complaint with the Romanian National Supervisory Authority for Personal Data Processing (www.dataprotection.ro) or to go to the competent courts.
(Ch. VII)
